When probating a lost, destroyed, or otherwise unavailable Will, remember to include a statement to that effect in the notice of the initial hearing as mandated by 524.3-403(a) of the Minnesota Probate Code. The best practice is to include language indicating the status of the Will throughout the notice. For example, if the Will has been lost, include the language “Lost Will” wherever you would normally find the word “Will” in the notice.
