Abandoned Ashes

by Boyd Johnson on September 4, 2008

A recent AP story details a growing national problem: unclaimed cremation ashes.

The article indicates that there is no consensus among the states on how to deal with this issue. How has Minnesota dealt with this problem?

Generally, the crematory or funeral establishment is required to give written notice by certified mail to appropriate persons if the remains are not claimed within 30 days of the inurnment. If no one steps forward to claim the remains within 120 days after the notice is given, the crematory may dispose of the remains in any lawful manner deemed appropriate. See Minn. Stat. 149A.95, subd. 19 for details.
